Section 1
1. Short title This Act may be cited as Dillon’s Law.

2. Preference for States that allow trained individuals to administer epinephrine at schools Section 399L(d) of the Public Health Service Act (42 U.S.C. 280g(d)) is amended— in paragraph (1)(F)— in the subparagraph heading, by striking School personnel and inserting Trained personnel; in the heading for clause (ii), by striking school and inserting trained; and by adding at the end the following: For purposes of this subparagraph, an elementary school or secondary school in a State may treat an individual who is not an employee of the school as being part of the trained personnel of the school if— the individual meets the requirements of paragraph (3)(E); and the State attorney general reaffirms the certification of the State under subparagraph (G), taking into account the treatment of individuals authorized by this clause. in paragraph (3)(E), in the matter preceding clause (i), by striking , such as the school nurse. Section 399L(d)(3)(C) of the Public Health Service Act (42 U.S.C. 280g(d)(3)(C)) is amended by striking auto-injectable epinephrine and inserting epinephrine delivery systems. Section 399L(d)(1)(F)(i) of the Public Health Service Act (42 U.S.C. 280g(d)(1)(F)(i)) is amended by striking schoolin and inserting school in. (iv)Special ruleFor purposes of this subparagraph, an elementary school or secondary school in a State may treat an individual who is not an employee of the school as being part of the trained personnel of the school if— (I)the individual meets the requirements of paragraph (3)(E); and
(II)the State attorney general reaffirms the certification of the State under subparagraph (G), taking into account the treatment of individuals authorized by this clause.; and
