Section 1
1. Short title This Act may be cited as the Child Care Nutrition Enhancement Act of 2023.

2. Reimbursements under CACFP program Section 17 of the Richard B. Russell National School Lunch Act (42 U.S.C. 1766) is amended— in subsection (c)— in paragraphs (1), (2), and (3), by inserting and subject to paragraph (7) after subsection (f)(3) each place it appears; and by adding at the end the following: Beginning on the first day of the first month that begins after the date of enactment of this paragraph, each meal and supplement served under this section shall receive an additional reimbursement in the amount of 10 cents (as adjusted pursuant to section 11(a) of this Act). in subsection (f)(2)(A), by striking multiplying the and all that follows through the period at the end and inserting the following: multiplying— the total number of each type of meal (breakfast, lunch, or supper) or supplement served in such institution in that fiscal year; and the sum obtained by adding the applicable national average payment rate for each such type of meal or supplement, as determined under subsection (c), to the additional reimbursement amount required under paragraph (7) of that subsection. in subsection (o)(3)(A), by inserting (including the additional reimbursement amount required under subsection (c)(7)) before the period at the end; in subsection (r)(4)(B)— in clause (i), by inserting plus the additional reimbursement amount required under paragraph (7) of that subsection before the period at the end; and in clause (ii), by inserting plus the additional reimbursement amount required under subsection (c)(7) before the period at the end; and in subsection (t)(5)(B), by inserting plus the additional reimbursement amount required under paragraph (7) of that subsection before the period at the end. Section 17(f)(3) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1766(f)(3)) is amended— in subparagraph (A)— in clause (ii)— in the heading, by striking Tier i family or group day care homes and inserting Calculation of reimbursement; by striking subclause (I); by redesignating subclauses (II), (III), and (IV) as subclauses (I), (II), and (III), respectively; in subclause (I) (as so redesignated)— by striking subclause (III), a tier I and inserting subclause (II), a; and by striking , except that and all that follows through section 9; in subclause (II) (as so redesignated)— by striking subclause (IV) and inserting subclause (III); and by striking subclause (II) and inserting subclause (I); in subclause (III) (as so redesignated), in the first sentence, by striking food at home and inserting food away from home; and by adding at the end the following: The additional reimbursement amount required under subsection (c)(7) shall apply to the reimbursements of meals and supplements under this subparagraph. by striking clause (iii); and by striking subparagraph (E). (7)Additional reimbursementBeginning on the first day of the first month that begins after the date of enactment of this paragraph, each meal and supplement served under this section shall receive an additional reimbursement in the amount of 10 cents (as adjusted pursuant to section 11(a) of this Act).; multiplying—(i)the total number of each type of meal (breakfast, lunch, or supper) or supplement served in such institution in that fiscal year; and(ii)the sum obtained by adding the applicable national average payment rate for each such type of meal or supplement, as determined under subsection (c), to the additional reimbursement amount required under paragraph (7) of that subsection.; (IV)Additional reimbursementThe additional reimbursement amount required under subsection (c)(7) shall apply to the reimbursements of meals and supplements under this subparagraph.; and
