1. Short title This Act may be cited as the Intelligence Community Property Security Act of 2025.

2. Unauthorized access to intelligence community property The National Security Act of 1947 (50 U.S.C. 3001 et seq.) is amended by adding at the end the following: It shall be unlawful, within the jurisdiction of the United States, without authorization to access any property that— is under the jurisdiction of an element of the intelligence community; and has been clearly marked as closed or restricted. Any person who violates subsection (a) shall— in the case of the first offense, be fined under title 18, United States Code, imprisoned for not more than 180 days, or both; in the case of the second offense, be fined under such title, imprisoned for not more than 3 years, or both; and in the case of the third or subsequent offense, be fined under such title, imprisoned for not more than 10 years, or both. The table of contents preceding section 2 of such Act is amended by adding at the end the following: 1115.
Unauthorized access to intelligence community property
(a)
In general
It shall be unlawful, within the jurisdiction of the United States, without authorization to access any property that—
(1)
is under the jurisdiction of an element of the intelligence community; and
(2)
has been clearly marked as closed or restricted. (b) Penalties Any person who violates subsection (a) shall—
(1)
in the case of the first offense, be fined under title 18, United States Code, imprisoned for not more than 180 days, or both;
(2)
in the case of the second offense, be fined under such title, imprisoned for not more than 3 years, or both; and
(3)
in the case of the third or subsequent offense, be fined under such title, imprisoned for not more than 10 years, or both.
