1. Requests by Indian Tribes for CFIUS review Section 721(a)(4) of the Defense Production Act of 1950 (50 U.S.C. 4565(a)(4)) is amended by adding at the end the following: Upon the written request of an Indian Tribe (as defined in section 4(e) of the Indian Self-Determination and Education Assistance Act, (25 U.S.C. 5304(e))) with respect to a transaction between such Indian Tribe and a foreign person (other than an Indian Tribe), this section shall apply— to such transaction in the same manner as this section applies to a covered transaction; and to the business or real estate that is the subject of such transaction in the same manner as this section applies to a United States business or real estate located in the United States. (G)Requests by Indian Tribes for review of transactionsUpon the written request of an Indian Tribe (as defined in section 4(e) of the Indian Self-Determination and Education Assistance Act, (25 U.S.C. 5304(e))) with respect to a transaction between such Indian Tribe and a foreign person (other than an Indian Tribe), this section shall apply—(i)to such transaction in the same manner as this section applies to a covered transaction; and(ii)to the business or real estate that is the subject of such transaction in the same manner as this section applies to a United States business or real estate located in the United States. .
