Section 1
1. Short title This Act may be cited as the Fairness in Medicare Savings Program Act of 2023.

2. Expanding the Medicare Savings Program to the territories Section 1905(p)(4) of the Social Security Act (42 U.S.C. 1396d(p)(4)) is amended by inserting for fiscal years through 2023 after Columbia). Section 1108(g)(4) of the Social Security Act (42 U.S.C. 1308(g)(4)) is amended by adding at the end the following new subparagraph: Payments under section 1903 for medical assistance consisting of medicare cost-sharing (as defined in section 1905(p)(3)) furnished on or after October 1, 2023, shall not be taken into account in applying any limit under subsection (f) or this subsection. (C)Exclusion relating to Medicare cost-sharingPayments under section 1903 for medical assistance consisting of medicare cost-sharing (as defined in section 1905(p)(3)) furnished on or after October 1, 2023, shall not be taken into account in applying any limit under subsection (f) or this subsection..
