Section 1
1. Short title This Act may be cited as the Death Penalty for Dealing Fentanyl Act of 2025.

2. Knowing distribution of fentanyl where death results Part D of the Controlled Substances Act is amended by adding at the end the following: Any person who is convicted of an offense under section 401(a)(1) or section 416 by distributing, possessing with intent to distribute, or manufacturing fentanyl shall, if death results, be punished— by death or imprisonment for any term of years or for life; and by a fine under title 18, United States Code. 424.Knowing distribution of fentanyl where death resultsAny person who is convicted of an offense under section 401(a)(1) or section 416 by distributing, possessing with intent to distribute, or manufacturing fentanyl shall, if death results, be punished— (1)by death or imprisonment for any term of years or for life; and
