Section 1
1. Short title This Act may be cited as the Manufactured Housing Affordability and Energy Efficiency Act of 2023.
Section 2
2. Clarification of HUD final authority over manufactured housing energy efficiency standards Section 413 of the Energy Independence and Security Act of 2007 (42 U.S.C. 17071) is amended by inserting the following new subsection: The manufactured housing energy efficiency standards developed by the Secretary of Energy under subsection (a) shall be considered by the Secretary of the Department of Housing and Urban Development under section 604(a) of the National Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. 5401 et seq.) and shall only become effective and enforceable, under subsection (c) or otherwise, if and in the form adopted into the Manufactured Housing Construction and Safety Standards (24 C.F.R. 3280) pursuant to section 604(a) of such Act. 3. Elimination of inappropriate use of IECC Section 413(b) of the Energy Independence and Security Act of 2007 (42 U.S.C. 17071(b)) is amended to read as follows: The energy conservation standards established under this section may be based on the climate zones established by the Department of Housing and Urban Development. 4. Supremacy of HUD code Section 604 of the National Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. 5403) is amended by inserting the following new subsection: Any construction or safety standard developed by other Federal agencies, including energy standards developed pursuant to section 413 of the Energy Independence and Security Act of 2007 (42 U.S.C. 17071), shall only become effective and enforceable by HUD or such other agency if and in the form adopted into the construction and safety standards established under subsection (a). (i)Exclusive authority over manufactured housing energy standardsAny construction or safety standard developed by other Federal agencies, including energy standards developed pursuant to section 413 of the Energy Independence and Security Act of 2007 (42 U.S.C. 17071), shall only become effective and enforceable by HUD or such other agency if and in the form adopted into the construction and safety standards established under subsection (a)..
